Issues Faced by Same-Sex Couples that Relate to Estate & Tax Planning
With the Supreme Court’s landmark decision in the United States v. Windsor (June 26, 2013), the world of taxation has had its first major upheaval in quite some time. Same-sex couples that had previously been married under state law (currently 14 laws have legalized same-sex couple unions) now had rights under federal law where previously they had been denied due to DOMA (The Defense of Marriage Act). With the Court’s 5-4 ruling, 2013 will prove to be a tax year never before seen.
