Issues Faced by Same-Sex Couples that Relate to Estate & Tax Planning

Constitution-No-DOMAWith the Supreme Court’s landmark decision in the United States v. Windsor (June 26, 2013), the world of taxation has had its first major upheaval in quite some time.  Same-sex couples that had previously been married under state law (currently 14 laws have legalized same-sex couple unions) now had rights under federal law where previously they had been denied due to DOMA (The Defense of Marriage Act).  With the Court’s 5-4 ruling, 2013 will prove to be a tax year never before seen.
